High Court: The Delhi High Court has allowed a man to retrieve his 19-year-old car from a scrapyard. However, he will have to pay a fee of ₹1.5 lakh.
Delhi High Court has allowed a man to recover his 19-year-old vehicle from a scrapyard. But he will have to pay ₹1.5 lakh as a fee.
A single-judge bench of Justice Mini Pushkarna wrote in its order that houses, cars, and animals are part of our lives. Individuals form an emotional connection with them, and this attachment cannot be easily severed.
NRI Rajeshwar Nath Kaul's 19-year-old car, which he had brought from abroad, came under the scrutiny of the Municipal Corporation (MCD) after it exceeded the prescribed age limit. The corporation declared it a scrap and confiscated it. Kaul then approached the court and argued about his deep attachment to the car.
Understanding his feelings, the court ruled that he could get his car back if he paid the fees for the period the vehicle was seized. Thus, he was allowed to free his car from the scrapyard.
The court wrote in its order, "Homes, vehicles, and pets have become integral parts of people's lives. This connection often leads people to cross the boundaries set by society and the law. In such cases, courts should adopt a sensitive approach and consider a different perspective."
The court also stated that citizens have the right to protect their emotionally attached belongings and pets, as per the law.
