The Home Ministry has tightened the OCI card rules. According to the new rules, if the OCI card holder is found guilty of a serious crime and is jailed for at least two years or is accused of a crime punishable with imprisonment of seven years or more, then his OCI card will be cancelled.

The Home Ministry has issued a notification tightening the rules related to the Overseas Citizen of India (OCI) card, which allows foreign nationals of Indian origin to come to India without any visa.

It provides that if the overseas Indian citizen cardholder is convicted of a serious offence, has been sentenced to two years' imprisonment or more, or has been named in the charge sheet formally for an offence which can be punished with imprisonment for seven years or more in cases involving serious charges, then their OCI card will be revoked.

The notification said, "In exercise of the powers conferred by clause (da) of section 7D of the Citizenship Act, 1955 (57 of 1955), the Central Government hereby clarifies that the registration of an Overseas Citizen of India (OCI) can be cancelled if he has been sentenced to imprisonment for a term of at least two years or has been chargesheeted for an offence punishable with imprisonment for seven years or more."

It is worth noting that the OCI scheme was launched in August 2005. It provides for registration as OCI of all persons of Indian origin who were citizens of India on or after 26 January 1950 or were eligible to become citizens of India on 26 January 1950, except those who are or have been citizens of Pakistan, Bangladesh or any other country which the Central Government may specify by notification in the Official Gazette.
