Judges will not be able to take decisions through AI! Kerala High Court issued new guidelines, action will be taken on breaking the rules
AI: Taking a historic step, the Kerala High Court has issued a strict guideline regarding the use of Artificial Intelligence (AI) in the district judiciary. Under this, under no circumstances will AI tools be used for judicial decisions or legal analysis.

Now Artificial Intelligence (AI) tools are not applicable for taking judicial decisions. Going a historic step in this direction, the Kerala High Court has released a new guideline, where the district judiciary has been ordered to use AI in limited and responsible ways.
The 'Policy regarding the use of Artificial Intelligence Tools in the District Judiciary' issued by the High Court clearly states that AI tools can be used only as an auxiliary tool, not for any decision or legal opinion.
According to the court, this is the first such policy in the country which clearly defines the scope of AI in the judicial process. It states that indiscriminate use of AI can lead to serious consequences such as violation of privacy, data security risks and lack of confidence in the judicial system.
According to the policy document, "AI tools will be used only for specially permitted tasks. They cannot be used under any circumstances in making judicial orders, conclusions, relief or decisions." The purpose of this policy is to make judges and judicial staff aware of their ethical and legal duties. It states that it is mandatory to maintain human supervision, transparency, impartiality, confidentiality and accountability.
There is also a provision of a disciplinary measure for breaching this policy. This rule will also extend to the state district judiciary, their employees, and interns or law clerks who work for them.
The policy further encompasses generative AI tools like ChatGPT, Gemini, Copilot and Deepseek. It further declares that regardless of whether AI tools are used on personal, court or third party devices, this policy will cover all scenarios.
