ASI survey will continue in Bhojshala, Supreme Court rejects the petition; asked to go to high court
Bhojshala Survey ASI survey: This petition was filed in the Supreme Court regarding the interim order given by the Indore High Court to ASI for a survey of Bhojshala. Whereas the petitioner was not a party in the High Court, the Supreme Court refused to hear the matter and asked the petitioner to go to the High Court.
ASI survey will continue in Dhar's Bhojshala. Today the Supreme Court has rejected the petition filed against the survey and refused to hear it. The petition was filed by Qazi Moinuddin, the mutawalli (caretaker) of Kamal Maula Masjid.
This appeal against the Indore High Court's interim order directing ASI to survey Bhojshala was submitted to the Supreme Court. Additionally, the petitioner was not a party in the High Court; as a result, the Supreme Court declined to take up the case and requested that the petitioner appear in the High Court.
The Supreme Court's decision on Monday to not prohibit the ASI survey of Bhojshala is especially noteworthy. Still, the court declared that no action based on the survey results would be taken without its consent. The petition contesting the ASI survey of Bhojshala has also been served with notice by the court.
After hearing the arguments of the petitioner's lawyer, the Supreme Court issued notice to the Central Government, State Government and ASI and directed them to file their reply within four weeks.
The top court said in its order that no action would be taken based on the results of the survey report without the permission of the court. It was also clarified that no excavation will be done during the survey which would change the character or nature of the premises.
