Supreme Court rejects parents' plea, 'Children are not property, accept the marriage of your adult daughter'
SC: The Supreme Court has rejected the plea of parents from Madhya Pradesh, in which they claimed that their minor daughter was kidnapped and forced to marry. The court has given this decision on the basis of the girl's statement and the wrong birth certificate presented by the family.
The country's Supreme Court rejected the plea on Friday of a woman's parents, in which she had demanded criminal action against her partner. On this basis, the woman had alleged that she was a minor at the time of her marriage. In the case, the bench of Chief Justice Sanjeev Khanna and Sanjay Kumar said that the girl was not a minor at the time of marriage and the FIR was registered against her because her parents did not accept the marriage.
The Chief Justice said, "You do not have the right to imprison... You do not accept the relationship of your adult child. You consider your child a property. Children are not property." During this, the bench also mentioned the discrepancies in the date of the birth certificate presented by the woman's parents and said that it is not pursuing the matter further. The bench said, 'We are not inclined to interfere with the order of the High Court.'
On August 16, the Indore bench of the Madhya Pradesh High Court dismissed the FIR against a resident of Mahidpur in a case related to the alleged kidnapping and sexual assault of a minor. The father had lodged an FIR under various sections related to kidnapping, etc., stating that his 16-year-old girl was missing.
It was in this context that the family alleged the abduction of their daughter, luring her away with a man. During this time, the High Court rejected the FIR considering the very fact that the girl was an adult married of her consent. During this tenure, the apex court would not interfere in this case and refused to interfere with the decision of the High Court.
