According to the Supreme Court, just 40% of disability can not prevent a person from studying medicine. Until a report from an expert says that person is not capable of studying MBBS.

In its September 18 order, the division bench of Justices BR Gavai, Arvind Kumar, and KV Vishwanathan provided thorough justifications for allowing a candidate to pursue MBBS on Tuesday. Because the medical board believed that he could continue his medical study without any obstacles.

The division bench said that it is necessary to take the opinion of the Disability Assessment Board to assess the ability of a disabled candidate to pursue MBBS education. He said that a candidate cannot be disqualified for MBBS studies just because of his disability.

The assessment done by the Disability Board will state whether the candidate can continue further MBBS studies or not. The Supreme Court also said that in case the Disability Board feels a candidate cannot continue the course further, then it should also put it in words regarding the reasons for it.

The Supreme Court has given this decision on the petition of a student Omkar who has challenged the Graduate Medical Education Exchange, 1997 Act. As per this act, a candidate receiving 40 percent or more disability is not entitled to do MBBS.

A plea that sought stay on the elections to Punjab Panchayats was ordered to be dismissed by the Supreme Court today. The Supreme Court today refused to stay the ongoing Panchayat elections in Punjab over alleged irregularities in the nomination process and said if the Courts start stopping the elections on the day of voting there will be 'chaos'.

CJI DY Chandrachud said, 'Voting having started today, how can we at this stage interfere?' Taking the seriousness of the matter into consideration, the High Court vacated the stay on the elections. The CJI said, 'If we stop voting, that too on the day of polling, there will be chaos.
