SC bluntly on the matter of appointment of DERC Chairman, will have to wait for the decision of the Constitution Bench
Supreme Court: The Supreme Court on Wednesday said that the outcome of the proceedings pending before a five-judge Constitution bench on the issue of appointment of the Chairman of Delhi Electricity Regulatory Commission (DERC) will have to be awaited. A bench of Justice Manoj Mishra said that Justice Jayant Nath (Retd.) has taken charge of the electricity tariff regulatory body as Chairman as per the interim direction passed by the apex court.

The Supreme Court on Wednesday said it will have to wait for the outcome of the proceedings pending before a five-judge Constitution bench on the issue of appointment of the Chairman of Delhi Electricity Regulatory Commission (DERC).
A bench headed by Chief Justice DY Chandrachud and comprising Justices JB Pardiwala and Manoj Mishra said Justice Jayant Nath (Retd.) has taken charge of the electricity tariff regulatory body as Chairman in accordance with the interim direction passed by the apex court.
In August, the Supreme Court named former Delhi High Court judge Justice Nath as the ad-hoc chairman of DERC after Delhi's Lieutenant Governor and Chief Minister failed to agree on a common name.
It may be noted that the Delhi government has challenged the provisions of the National Capital Territory of Delhi (Amendment) Act, 2023, which gives special powers to the Lieutenant Governor over the elected government in the matter of appointments. The petition is pending before a five-judge Constitution bench.
