New petition filed in SC challenging CAA rules, response sought from Central and Assam government

The Supreme Court on Friday sought a response from the Center and Assam government on a petition challenging the Citizenship (Amendment) Rules, 2024. A bench of Chief Justice DY Chandrachud and Justice JB Pardiwala carefully heard the arguments of a lawyer representing petitioner Guwahati resident Hiren Gohain and then issued notices to the state government and the Union home and external affairs ministries.

The court also ordered that the new petition be tagged with the pending petitions on the issue. The petition said that the uncontrolled influx of illegal immigrants from Bangladesh into Assam resulted in huge demographic changes in the state. The natives, who were once in the majority, are now a minority in their land.

Recently, the bench, while refusing to stay the operation of the CAA rules, asked the Center to respond to the applications seeking a stay on their implementation till the court disposes of the petitions challenging the validity of the CAA. Was done.

The petitioner said in the petition that the CAA Rules, 2024 "violate the Constitution" as they are discriminatory, one-sided, illegal and against the basic structure of the Constitution. The petition raised the issue of an 'uncontrolled' influx of illegal immigrants from Bangladesh into Assam, saying that this is not a communal issue.
