Chief Justice of the country (CJI) DY Chandrachud has said that not only historically but also the complex reality of today's law has perpetuated caste division. In such a situation, reservation and other positive efforts by the government (state) are the only ray of hope to remove inequalities. CJI Chandrachud was speaking as the keynote speaker at the 36th LawAsia conference in Bengaluru on Saturday. He said we must acknowledge the complexities inherent in the law that perpetuate inequalities.

CJI Chandrachud has said that today the meaning of freedom has changed. Historically, liberty meant freedom from government interference in individual actions and decisions, but contemporary scholars have come to the conclusion that the role of government in removing social prejudices cannot be ignored. Where the government does not interfere, socially and economically prosperous communities are automatically allowed to dominate historically marginalized people. Giving the example of tribal communities, he explained that for them, the right to their own land is freedom and the government's right to the land shows discrimination against them.

The CJI said that to remove the inherent systemic discrimination in our society, it is necessary that people are not divided into different identities. People with disabilities are forced to obtain eligibility certificates for any benefits and setting criteria for the same results in many people being deprived of benefits. In such a situation, we need to help them. Similarly, making 'gender' based laws benefited men and harmed women. The CJI referred to two decisions of the Supreme Court under which women were allowed permanent commission in the armed forces and the ban on employment of women in any liquor-related institution was lifted.
