The Central Government has filed an affidavit in the Supreme Court, claiming that triple talaq endangers the marital structure in society. It worsens the situation for Muslim women. The Central Government maintained that even the Supreme Court's 2017 judgment prohibiting triple talaq in the Muslim community was ineffective in reducing talaq instances. In such cases, it is vital to criminalize the behavior. The Central Government stated that victims of triple talaq had no choice but to approach the police. At the same time, the police were useless in this situation because there was no provision in the law for stern punishment, making it difficult to take action against the accused husband.

In fact, in the petition filed by Kerala Jamiatul Ulema in the Supreme Court, it was said that when the court has declared triple talaq illegal, then there is no point in criminalizing it. The petitioner had called the Muslim Women (Protection of Rights after Marriage) Act 2019 unconstitutional and said that it was a violation of fundamental rights. It cannot be declared a crime in any law on the basis of religion. Regarding this petition, the Central Government has filed an affidavit in the Supreme Court and put forth its stand.
