The Kerala High Court just handed the Enforcement Directorate (ED) a major victory in the Cochin Minerals and Rutile Limited (CMRL) case. They turned down CMRL’s request to halt the ED’s investigation, allowing the ED to press on. Rahul Naveen, the ED Director, made it to Kochi and plans to meet with top officials for a rundown of the situation.
Last Friday, a two-judge panel consisting of Justices Raja Vijayaraghavan V. and KV Jayakumar, dismissed CMRL’s appeal. This appeal questioned an earlier decision by a single judge who shot down their plea to put the brakes on the ED probe.
Furthermore, the court squashed CMRL’s claim that registering a scheduled offense is mandatory before starting an ED inquiry. According to the judges, while such registration might be necessary for criminal accusations, it isn’t required for things like seizing assets or exercising other investigative powers under the Prevention of Money Laundering Act (PMLA).
The court also refused to quash the Enforcement Case Information Report (ECIR) filed by the ED. The court stated that an ECIR is not a statutory document and its absence does not prevent the ED from initiating civil proceedings.
CMRL is under investigation for allegations of financial irregularities, bribery, and money laundering. The matter has also become politically sensitive due to allegations that the company made illegal payments to Exalogic Solutions Private Limited, an IT company linked to Veena Thaikkandiyil, daughter of former Chief Minister Pinarayi Vijayan. The Serious Fraud Investigation Office (SFIO) is also investigating the matter.
Earlier, CMRL and four of its officials had filed a petition in the High Court seeking to quash the ED proceedings. However, a single bench dismissed the petition, stating that the challenge was premature, filed so soon after the agency issued summons.
The single bench also referred to the SFIO's complaint in its order, which alleges offenses under the Companies Act. These offenses fall under the category of scheduled offenses under the PMLA.
Following this decision, the ED also conducted searches at the residences of Pinarayi Vijayan and his family members, further increasing the political significance of the case. Now, following the High Court's latest decision and ED Director Rahul Naveen's visit to Kochi, there are signs of an intensification of the investigation. It is believed that the ED may make important decisions regarding further action in the case in the coming days.
